This Privacy Policy (“Privacy Policy”) applies to information we collect about you offline and through our online services where we post this Privacy Policy, including, but not limited to, through 800Salons.com, and other affiliated websites (collectively, referred to as the “Site”), the mobile app (the “App”), and related services (collectively, the “Services”). This Privacy Policy describes the types of personal information and other data that 800 Salons Spots. (“800 Salons Spots,” “we,” “our,” or “us”) collects about you, how we use the personal information we collect, with whom we disclose it, and choices you may have regarding your personal information.
The Services are primarily available to artists, stylists, makeup, skin, or hair professionals, wellness professionals, and other beauty and wellness merchants and their employees (the “Professionals”). Certain features of our Services are also available to individuals who may be clients of Professionals or who are seeking services provided by Professionals (the “Clients”). For purposes of this Privacy Policy, “you” or “your” refers to any individual Professional or Client, as appropriate.
Please keep in mind that this Privacy Policy only applies to the Services provided by us and does not describe how the Professionals with whom you connect may use your personal information. Please contact the Professionals with whom you do business to learn about their data handling practices. In addition, we’re not responsible for the data handling practices of other websites, apps or services we do not control, including those to which we may include links on our Services or that link to us. We encourage you to review the privacy policies and notices of any other website, app or service through which you may submit your information.
By accessing or using the Services or otherwise providing us with your personal information, you acknowledge the applicability of this Privacy Policy. If you do not agree to this Privacy Policy, please do not access or use the Services or provide us with your personal information.
The Information We Collect
We obtain information about you through the means discussed below when we provide the Services. Please note that we need certain types of information to provide the Services to you. If you do not provide us with such information, or if you ask us to delete that information, you may no longer be able to access or use certain aspects of the Services.
a. Information you provide directly to us
We may collect information that you provide directly to us through:
Your use of the Services, e.g. as a Professional, you will need to register and create a 800 Salons Spots account to use the Services;
Your participation in surveys or submission of forms, e.g. if you complete a survey related to the Services or following an appointment with a Professional, we will obtain the information you provide in response to the survey, which may include your name, contact information, demographic data and concerns or interests related to Professionals’ services (for example, your hair or skin concerns);
Your communications with us, such as through customer support;
Your transmission of content to us, such as when you book an appointment or otherwise provide us with information through Services;
Your subscription to newsletters;
Your registration for promotions, sweepstakes, or other contests;
Your communications with us or other users through the Services, such as if you communicate with Professionals or Clients through the Services, through support chats or refer-a-friend feature; and
Your authorizations for us to access other information, such as Clients or other contacts.
The information you provide directly to us may concern you or others and may include, but is not limited to:
Identifiers and Contact Information. We may collect identifiers and other contact information from you, such as your name, home address, telephone number, email address, and/or username and password.
Financial Information. We may collect your bank account or credit card information through our payment processor vendors, to assist in making or receiving payments, e.g. when you book an appointment with a Professional . We may engage vendors to collect such payment information.
Personal Characteristics. In providing the Services or your responses to surveys, we may collect personal characteristics from you, such as your age, date of birth, gender, or interests.
Business Information. We may collect information about your business, such as the type of business, a business address, business phone, an email address, a cosmetology license number, your business URL, information about your services and business, such as the name of your services, description of services, duration and price, your business hours, payment preferences, cancellation fees and/or pictures or videos from your work portfolio or any other pictures or videos you choose to publish through the Services.
Information You Provide or Direct Us to Collect. You may provide or otherwise direct us to collect certain information, such as professional contacts, photographs, or video.
You are not required to provide us with such information, but certain features of the Services may not be accessible or available without providing the requested information.
b. Information from affiliates and nonaffiliated parties
We may collect information about you or others through our affiliates or through nonaffiliated parties. For example, to the extent permitted by law, we may, in our sole discretion, ask for and collect supplemental information from nonaffiliated parties, such as information to verify your identity or information for other fraud or safety protection purposes. We may combine information that we collect from you through the Services with information that we obtain from such other parties and information derived from other products or Services we provide.
We may also collect information about you from social media networks. When you “like” or “follow” us on Facebook, Instagram, Twitter, or other social media sites, we may collect some information from you including your name, e-mail address, and any comments or content you post relevant to us. We may also collect your information if you interact with social media features that may be made available on the Services, such as like and share buttons, or if you tag us or identify us in your social media posts. If you access the Services through a third-party account, such as Facebook or Google, (each a “Third-Party Service”), you may allow us to have access to certain information from the Third-Party Service. Depending on the Third-Party Service, the information disclosed to us may include your name, profile picture, gender, email address, photos, videos, people you follow and/or who follow you, and/or your posts or “likes.” Third-Party Services have their own policies for handling your information, and we encourage you to consult their privacy policies before accessing the Services with a Third-Party Service.
Other users may also provide information about you. For example, Clients or Professionals may authorize us to access contact information from their device or otherwise use the Services to facilitate sharing of offerings or to invite friends and others to use the Services. For instance, if you choose to invite or refer a friend to use the Services through our “Refer-a-Friend” feature, you may select a contact directly from the contacts list on your device and send him or her an SMS or email from your device. Alternatively, you can submit your contact’s phone number or email address and have 800 Salons Spots send the invite email. You understand and agree that you are responsible for any charges that apply to communications sent from your device to your contacts and that you shall only input contact’s phone or email address if you believe that they would be interested in a referral to the Services. Your use of our SMS functionality and our use of SMS to communicate with you is subject to our SMS Terms.
Payment Processing. In connection with our payment processor vendor, Stripe, we may collect certain payment information that you have provided to Stripe, including payment card number, expiration date, and authorization number or security code, and TIN, for purposes of providing our Services and troubleshooting and support purposes.
c. Information we collect automatically
Device/Usage Information. We and our vendors, which include ad networks and analytics companies such as Google Analytics, may use cookies, web beacons, and other tracking technologies to collect information about the computers or devices (including mobile devices) you use to access the Services. As described further below, we may collect and analyze information including but not limited to (a) browser type; (b) ISP or operating system; (c) domain name; (d) access time; (e) referring or exit pages; (f) page views; (g) IP address; (h) unique device identifiers (e.g. IDFA or Android ID); and (i) the type of device that you use. We may also track when and how frequently you access or use the Services, including how you engage with or navigate our website or mobile application. We use this information (including the information collected by our vendors) for analytics (including to determine which portions of the Services are used most frequently and what our users like/do not like), to analyze and improve our Services, to assist in determining relevant advertising (both on and off the Services), to evaluate the success of our advertising campaigns, and as otherwise described in this Privacy Policy.
Cookies and Other Electronic Technologies. We and our vendors may use cookies, clear GIFs, pixel tags, and other technologies that help us better understand user behavior, personalize preferences, perform research and analytics, and improve the Services. These technologies, for example, may allow us to tailor the Services to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about usage of our Services. We or our vendors also may use certain of these technologies in emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but your browser may allow you to modify your browser settings to decline cookies if you prefer. If you disable cookies, you may be prevented from taking full advantage of the Services, because the Services may not function properly. As we adopt additional technologies, we may also gather additional information through other methods.
Location Information. When you use the Services, we may collect general location information (such as general location inferred from an IP address). We may also collect precise location information where you authorize such collection.
How We Use Information About You
We use your information for business and commercial purposes, such as:
To provide you with the Services, including to register you for an account, connect you with other Professionals using the Services, or in conducting your business with Clients;
To respond to your questions or inquiries, including to provide customer support and troubleshooting assistance;
To communicate with you, including to send you emails about products and Services that may interest you;
To manage and remember your preferences and personalize the Services;
To provide recommendations;
To analyze and improve the Services or any other products and services we provide;
To administer surveys, sweepstakes, promotions, or contests;
To verify your identity;
To comply with our legal obligations or as permitted by law;
To protect the safety and/or integrity of our users, employees, other parties, members of the public, and/or our Services;
To prevent fraud and enforce our legal terms; and
To administer and troubleshoot the Services.
To the extent we do collect your license or ID number, we will do so for our identification verification procedures, fraud prevention purposes, as needed to enforce our rights and obligations under this Privacy Policy and 800 Salons Spots’s Terms of Service, or as otherwise required under applicable laws.
We may combine information that we collect from you through the Services with information that we obtain from affiliated and nonaffiliated parties, and information derived from any other products or services we provide.
We may aggregate, anonymize, and de-identify information collected through the Services. We may use de-identified, anonymized, and aggregated data for any purpose, including without limitation for research and marketing purposes and may also disclose such data with any other parties, including without limitation, advertisers, promotional partners, sponsors, and/or others. Data obtained through the short code program will not be shared with any third-parties for their marketing reasons/purposes.
When We Disclose Information About You
We may disclose information in the following situations:
Affiliates. We may disclose your information with any affiliates.
Consent/At Your Direction. We may disclose your information to nonaffiliated parties based on your consent to do so. You consent to us disclosing your information to nonaffiliated parties (a) as required to facilitate booking an appointment with Professionals; (b) when we have your express or implied permission; (c) where you participate in jointly-offered services or promotions by 800 Salons Spots and another party; or (c) as described in this Privacy Policy, the Terms of Service, or any other legal terms governing your use of the Services. For example, if you participate in our community program or interact and tag 800 Salons Spots on social media, such posts may be available to other users. And if you interact with certain social network channels managed by 800 Salons Spots, such as by clicking a “like” button, such interaction may cause certain types of your information to be disclosed to social networks.
Vendors. We provide access to or disclose your information with select parties who perform services on our behalf. They provide a variety of services to us, including data storage, analytics, billing, payment processing, marketing, product content and features, customer service, data storage, security, fraud prevention, and legal services.
Protection of 800 Salons Spots and Others. We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to (i) protect or defend the rights, safety, or property of 800 Salons Spots or other parties, including to defend or enforce our Privacy Policy, our Terms of Service, or any other contractual arrangement; (ii) respond to your requests for customer service; and/or (iii) protect the rights, property or personal safety of 800 Salons Spots, its agents and affiliates, its employees, users and/or the public.
Legal Requirements. We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to comply with any law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations.
Business Transfer. We may disclose certain information, in connection with or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
Aggregate/Anonymous Information. From time to time, we may disclose aggregate/anonymous/deidentified information about use of the Services, such as by creating reports on usage trends. The use and disclosure of such data is unrestricted.
Online Analytics and Tailored Advertising
a. Analytics
We may use web analytics services on the Services provided by other parties, such as those of Google Analytics. These vendors use the sort of technology described in the “Information we collect automatically” section above to help us analyze how users use the Services, including by noting the website from which you arrive. The information collected by the technology will be disclosed to or collected directly by these vendors, who use the information to evaluate your use of the Services. We also use Google Analytics for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-OutBrowser Add-on.
b. Tailored Advertising
We may also allow other parties with advertising technologies to place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about your use of the Services in order to (a) inform, optimize, and serve marketing content based on past visits to our websites and other sites and (b) report how our marketing content impressions, other uses of marketing Services, and interactions with these marketing impressions and marketing Services are related to visits to our websites. We may also allow other parties (e.g., ad networks and ad servers such as Google Analytics) to serve tailored marketing to you and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Services. If your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different computer or change web browsers, your NAI or DAA opt-out may no longer be effective. Your Rights and Choices Regarding Your Information
You have certain rights and choices with respect to your information such as:
Profile Information: You can update certain of your profile information by accessing your account.
Marketing Communications: You can unsubscribe from marketing emails by following the directions in those emails. Please note that if you unsubscribe from marketing emails, we may still send you administrative emails regarding the Services, including, for example, notices of updates to our Terms of Service or this Privacy Policy, in addition to communications and updates from a Professional to Client(s) that have expressed interest in booking with such Professional.
Cookies & Analytics: You can opt out of certain cookie-related and analytics processing by following the instructions in this Privacy Policy.
Your local law may provide you certain rights with respect to your personal information. Depending on your jurisdiction, you may request that we:
provide access to and/or a copy of certain information we hold about you;
prevent the processing of your information for direct-marketing purposes; (including any direct marketing processing based on profiling)
update information which is out of date or incorrect;
delete certain information that we are holding about you;
restrict the way that we process and disclose certain of your information;
transfer your information to a third-party provider of services; and
revoke your consent for the processing of your information.
Please note, however, that certain information may be exempt from such requests in some circumstances, which may include processing your information to comply with a legal obligation. We may request you provide us with information necessary to confirm your identity before responding to your request. Children’s Privacy
The 800 Salons Spots Services are not directed to, nor do we knowingly collect information from, children under the age of 13. If you become aware that your child or any child under your care has provided us with information without your consent, please contact us as indicated below. If we discover that an individual under 13 has provided us with personal information, we will close the account and delete the personal information to the extent required by the Children’s Online Privacy Protection Act. We may, where permitted by law, retain certain information internally for purposes described in this Privacy Policy.
Security of Information About You and Data Retention
We maintain administrative, technical, and physical safeguards to protect the personal information we obtain in connection with the Services. However, no information system can be 100% secure. Moreover, we are not responsible for the security of information you transmit to the Services over networks that we do not control, including the Internet and wireless networks. So, we do not promise and cannot guarantee, and thus you should not expect, that your personal data or communications will not be collected, disclosed and/or used by others. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. 800 Salons Spots is not responsible for the unauthorized use of your information nor for any lost, stolen, or compromised passwords, or for any activity on your account via unauthorized password activity.
We keep your information for the time necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and your choices, after which time we may delete and/or aggregate it. We may also retain and use this information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

The Services may contain links to other websites or services. We are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your information will be subject to the privacy policies of those websites or services, and not this Privacy Policy. Additional Information and Legal Rights Under Local Laws
a. Nevada Residents
In addition to the rights above, under Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. We do not engage in such activity; however, if you are a Nevada resident who has purchased or leased goods or services from us, you may submit a request to opt out of any potential future sales under Nevada law by emailing helpdesk at 800salons.com with the subject line “Nevada Sale Opt-Out”. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.
b.California Residents
This supplemental privacy notice supplements the information in our Privacy Policy, and except as provided herein, applies solely to California residents. This supplemental notice does not apply to personal information we collect from our employees and job applicants in their capacity as employees and job applicants.
Details of Processing. California law requires us to disclose information regarding the categories of personal information and sensitive personal information that we have collected about California consumers, the categories of sources from which the information was collected, the business or commercial purposes (as those terms are defined by applicable law) for which the information was collected, and the categories of parties to whom we disclose personal information. Throughout our Privacy Policy, we discuss in detail the types of personal information we collect from and about our users. Under California law, we are also required to provide you with the “categories” of personal information we collect as defined by California law.
Depending upon your use of the Services, in the preceding twelve months, we or our vendors may have collected the below categories of personal information for business or commercial purposes: identifiers (including name, mailing address, business address, phone number, email address); commercial information (such as reservation and transaction data); demographic information (such as your age and gender); financial Information (such as payment or other financial information when you use the card reader or make a payment); internet or other network or device activity; network or device information (such as an IP address, app identifiers, browsing history, or other usage data); location information (such as general location information (such as those inferred from an IP address) or precise location information where you authorize such collection); sensory information (such as when you contact customer support and we record such calls after notifying you); professional or employment-related information (such as your business email, telephone number, mailing address, and professional license number); and inferences. We may also collect other information that identifies or can be reasonably associated with you, such as when you send us communications. We may have also collected or may collect the following categories of sensitive personal information, as defined by California law: geolocation, account log-in and password or other credentials allowing access to your account, social security number, driver’s license number, state ID number, and the contents of communications between users, such as between Professionals and Clients.
We collect the categories of personal information identified above from the following sources: (1) directly from you; (2) through your use of the Services; (3) affiliates; and (4) other parties, such as our partners that assist with fraud prevention or where you direct other parties such as social networks to provide us with information.
We collect personal information for the reasons identified in the Privacy Policy, which generally includes the following business and commercial purposes: to provide the Services, e.g. account servicing and analytics; customer service; auditing consumer interactions on our Services; detecting, protecting against, and prosecuting security incidents and fraudulent or illegal activity; bug detection, error reporting, and activities to maintain the quality or safety of the Services; internal research; maintaining, improving, or developing services; operational purposes, including enabling and troubleshooting the Services; other uses that advance our commercial or economic interests, such as advertising and communicating with you about relevant offers from partners; and other uses about which we notify you.
We describe our information disclosure practices in the Privacy Policy above. In the previous twelve months, we may have disclosed certain categories of personal information with vendors that provide services to us. You may also direct us to disclose your personal information through the Services, such as when you use the Services to communicate with Clients about appointments.
Sharing of Personal Information. We may disclose your personal information to other parties for purposes of analytics and advertising. We provide information to analytics providers to better understand how consumers use the Services so we can improve the Services and create new products and services. We may also provide personal information to third-party advertising providers for targeted advertising purposes, so we can provide you with more relevant and tailored ads regarding our services. Under the CCPA, disclosing personal information to these third parties may be considered “sharing” of personal information for purposes of “cross-context behavioral advertising.” Depending on how you use the Services, we may “share” (and over the past 12 months may have shared) the following categories of information to ad networks, advertising partners, and/or analytics for such advertising:
identification and demographics; device information and identifiers, such as IP address, unique advertising identifiers and cookies, and hashed identifiers; connection and usage information, such as browsing history or app usage; location information, such as city; and inference data.
800 Salons Spots does not “sell” personal information as we understand such terms are currently defined under the CCPA.
If you or your authorized agent would like to opt out of our “sharing” of your information for such purposes, you may contact us at helpdesk at 800salons.com. You can also submit a request to opt out of our offline disclosures of information that are subject to applicable opt-out rights by contacting helpdesk at 800salons.com.
We do not knowingly “sell” or “share” the personal information of children under 16.
The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note that we do not use or disclose sensitive personal information other than for purposes for which you cannot opt out under the CCPA.
Retention of Your Personal Information. Please see the Security of Information About You and Data Retention section above.
Rights. In addition to the rights in Section 5 above, if you are a California resident, you may have the right to receive information about the financial incentives that we offer to you, if any. You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights.
If you would like to exercise any of your rights, please submit a request by emailing us. You will be required to verify your identity before we fulfill your request.
You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us.
Your California Privacy Rights. California residents can also request a list of all the other parties to which we have disclosed certain personal information (as defined by California’s Shine the Light law) during the preceding year for those other parties’ direct marketing purposes. We do not disclose your personal information with other parties for their own direct marketing purposes.

c. Virginia Residents
If you are a Virginia consumer (as that term is defined under the Virginia Consumer Data Protection Act (VCDPA)), you may have certain rights. Virginia law may permit you to request that we:
Confirm whether or not we are processing your personal information and provide you with access such personal information;
Correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information;
Delete your personal information;
Provide you a copy of personal information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business, where our processing is carried out by automated means; and
Opt you out of the processing of the personal information for purposes of targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide the Services to you. If you ask us to delete it, you may no longer be able to access or use the Services.

Consent to Transfer
800 Salons Spots is based in, and operates the Services from, the United States. If you reside outside the United States, please be aware that information we collect will be transferred to and processed in the United States and may be processed and stored in other countries outside the United States which may have data protection laws that differ from the laws in your country. By using the Services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside and/or are a citizen.
Updates to the Privacy Policy
We may change this Privacy Policy to reflect changes in the law, our information practices or the features of the Services. We will indicate the date of the most recent update in the Privacy Policy.
